At 12:00 am on April 1st, the 44th academic salon of law school was held successfully at Room 307, Koguan Building. The theme of the salon was "the construction of the system of the party's obligation of submitting the instruments". Professor ZhangWeiping from Tsinghua University Law School was the speaker, and the Party Secretary of Peking University Law School Pan Jianfeng hosted the activity. Many teachers including Dean of Peking University Law School Zhang Shouwen and Vice Dean of Peking University Law School Xue Jun and some doctoral studentsattended this activity.
Firstly, Prof. Zhang Weiping analyzed the various difficulties faced in practice of the judicial interpretation of Civil Procedure Law. He said that it was necessary to construct the system of theobligation of submitting the instrumentsin order to uphold the rights of the partiesout of the consideration of the cost of practice and the revelation of the truth in real lifeunder the background of the litigation system of authority.
Later,Prof. Zhang Weipingcomparedthe scope and intensity of the disclosure of evidence documents of Chinawith that of foreign countries and proposed the requirements for basic framework. He believed that the scope of submitting the instruments must comply with the substantive law and take into account the litigation law, and he thought the legal documents that related to the interests of each other orcould show the true meaning belonged to proposed necessarily documents.Prof. Zhang Weiping criticizedthe judicial tendency to change the special duty and the limited duty to the general obligation. He believed that China's national conditions should be combined to consider the scope of theobligations that the specific system set which should not to be expanded.At the same time, he pointed out that the document proposed system should have the corresponding procedures to specific, and the institutionalizationof the party's obligation of submitting the instruments still had a lot of problemsthat need to be further considered.
Then, the teachers had a deep discussion towards the specific issues, and discriminatedtheinstitution of the obligation of submitting the instruments and the rules of evidence. Besides, they put forward the necessity of positivization. The scene atmosphere was warm.
Finally, dean of Peking University Law School Zhang Shouwen issued a certificate for the teacher Zhang Weipingand they took a group photo to mark the occasion. So far, this academic salon activityheld successfully.
During the academic salon, the teacher Zhang Weiping introduced about the basic theory of the system ofthe party's obligation of submitting the instrumentsand had a comparative law analysisfrom the macro aspects, and put forward the system construction should be defined and discussed some controversy from the microscopic aspect. The academic salon not only wasa discussion of professional issues in civil litigation, but also related to a basic understanding of entity law and jurisprudence and more closely related with the stage of development of the rule of law in the country.  It was Small Car Big on Audi and provided an effective reference for the construction of the system ofthe party's obligation of submitting the instruments.
