First, Cao Zhixun began with the points and reasons of judgment, emphasizing the scarcity of the guiding cases as high quality resources. Then he quoted the American cases to detail the force of guiding of judgment documents and compared it with the present situation of our country. Meanwhile, he explained the application of the guiding case and introduced that the case facts were different and that the change of cases would influence the application of judging rules. Finally, he emphasized how to refine the basic idea of guiding cases and how to apply it.

Professors at the conference had a sharp debate on the concrete application of the China Securities Regulatory Commission to guiding cases. Many professors from Law School attended the debate, and Cao Zhixun answered every question raised by the professors. Thus, the thirty-eighth academic salon of Law School was held successfully.

The salon had a deep discussion about the feasibility of the guiding cases in the affairs. Professors compared the differences and similarities between Chinese and American precedent guiding and thought about the substantive role of the directive precedents in China’s social and legal issues, which is of great significance on the rich of the judicial interpretation of our country, the perfection of the legal system and the promoting of business of governing country by the law.
