Guo Li: Innovate the training method of outstanding foreign-related legal talents

 

The Fourth Plenary Session of the Eighteenth Central Committee of the Communist Party of China's "Decision on Several Major Issues Concerning the Comprehensive Promotion of the Rule of Law" proposed to build a team of foreign-related legal personnel who are familiar with international legal rules and are good at handling foreign-related legal affairs. At the 2019 meeting of the Central Committee for the Comprehensive Rule of law, President Xi Jinping stressed the need to strengthen the training of foreign-related professionals in the rule of law. The Ministry of Education has taken active actions to clarify the principle of "Morality and Law", include legal talents in the "Six Excellence and One Top-notch Program 2.0", and work with other ministries to study and deploy foreign-related legal services. Universities are also stepping up their efforts to explore new ways of training relevant talents.

Wang Junfeng, president of the All-China Lawyers Association, once suggested improving the language service capabilities of the “Belt and Road” initiative and increasing legal education in languages beyond English. Recently, China University of Political Science and Law and Beijing Foreign Studies University have joined forces with the goal of "double proficiency in foreign grammar" to test the cross-university training model for undergraduate and graduate students. Anglo-American common law is widely used in international commercial activities, but it is also a weakness in my country's traditional legal education. Tsinghua University has made great efforts to inherit history and accumulated certain experience. Peking University has in-depth cooperation with the University of Hong Kong to launch new degree programs such as the "Double Bachelor of Laws" to create talents who can integrate the rule of law between the two places, maintain Hong Kong's prosperity and stability, and strengthen its close ties with the mainland.

In addition to the teachers in the school constantly improving their own level and adjusting the teaching content, clever use of "external brain and external force" is also a good way. In 2018, Peking University Law School launched the "Global Chair" program, hiring 20 authoritative professors from Oxford University, Yale University, University of Tokyo and other universities to help the school's "double first-class construction" in all aspects. The courses of these famous foreign teachers have also been opened from offline to online this year, benefiting legal science students on a larger scale. At the same time, many universities actively cooperate with international organizations, arbitration institutions, well-known law firms, multinational companies, etc., and invite professionals with front-line experience in foreign-related legal services to participate in guiding students and enrich the training content.

Education faces the future, and education that combines with reality is often a more profound education. In the practice of responding to specific challenges in foreign-related laws, both the teachers and students benefit. When the Chinese government is leading the people to fight the epidemic bravely against malicious accusations and unreasonable litigation, when Huawei, TikTok and other companies come to overseas "legal traps", when relevant entities face various sanctions or threats, there are always teachers and students from law schools use what they have learned to fight and provide a lot of decision-making basis and action suggestions. In a sense, the turbulent international environment has built a unique set of "legal clinics" for today's law schools, and will create a rare profession and spirit in response to the situation.

The great changes in the world and the new development pattern, which have not happened in a century, require Chinese legal educators to further build up the “four consciousnesses” , strengthen the “four self-confidence” , innovate teaching methods with deeper reform and higher-level opening up, we will train more outstanding legal talents who understand and can shape international rules, handle foreign-related legal affairs with ease, and participate in international cooperation and competition.
