Professor Wang Jin, Environmental and Resources Protection Law




Wang Jin, born in Wuhan, Hubei Province in October, 1960, is now a full professor at Peking University Law School, the Director of Peking University Resources, Energy and Environmental Law Institute, and the Director of Peking University Nuclear Policy and Law Research Center. His areas of interest involve environmental law, natural resources law, nuclear law and energy policy.

 

 

 

[Professional Background]

As the first person earning Ph.D in environmental law in China, Prof. Wang Jin studied environmental law from Prof. Jin Ruilin in Peking Universitysince 1994 and received his Ph.D degree in 1997. During his Ph.D study in Peking University, he was sent as a visiting scholar by Environment Protection and Resources Conservation Committee of NPC to Uppsala University in Sweden from January to March in 1995 to research European environmental legislationsand as an exchange Ph.D candidate funded by the Japan Foundation to Hosei University to study theories on environmental law between September in 1996 and August in 1997. Prior to this, he learned from Prof. Xiao Longan and was awarded Master of Law from Wuhan University Law School in 1991 and Bachelor of Medicine from Wuhan Medical College in 1983.

Besides, he once served as lecturer and associate professor at Peking University Law School from 1997 to 2005, as teaching assistant and then as lecturer at Wuhan University Law School from 1986 to 1994, and as public health physician at Wuhan Qingshan Health and Epidemic Prevention Station from 1983 to 1986.

 

 

 

 

 

[Main Contributions]

Since conducting teaching, scientific research and practice in environmental law, economic law and nuclear law in 1986, Prof. Wang Jin has published several national textbooks on law of environment and resources. He is the author of Environmental Law (third editionin 2014, and first edition in 2006), which is among the legal textbooks under the national Tenth Five-Year Plan for regular institutions of higher learningby the Ministry of Education, and also the authoror co-author(co-translator) of more than 10 academic books or textbooks and over 100 academic papers published in famous Chinese and foreign legal and/or environmental science journals.

In 1997, he initiated in his doctoral dissertation the concept that the protection of environmental benefit shall be the aim of environmental legislations (also seen in Concept and Value Pursuit of Environmental Law——A Study onthe Objectives of Environmental Legislations published by Law Press in 2000). In 2000, he, invited by All China Lawyers Association (ACLA) as a part-time lawyer, founded and served as Director of Professional Committee on Environment, Resources and Energy Law. In 2005, he initiated an interpretative theory of taking instinctive right of using environment, different from the right of exploiting and utilizing environment, as one of the environmental rights of citizens (seen in Interpretation of Environmental Law——Problems and Solutions published by People’s Court Press in 2006). In December the same year, he, together with other fiveprofessors and students of PKU, filed the first civil environmentalpublic interestlitigationagainst ChinaNational Petroleum Corporation on behalf of natural objects in the extraordinary water contamination accidentin the Songhua River, which has laid a practical foundation for the rise of environmentalpublic interestlitigation in China. In 2012, when advising for an ecological environment infringement case of “All-China Environment Federationv. Management Committee of Lihu Huishan Scenic Area in Wuxi” heard by People’s Court in Binhu District of Wuxi, he first suggested “off-site after-replacement” as a method of the defendant bearing his liability of restoring to original condition or status, which was then adopted by the collegiate bench in its judgment (see [2012] Xibin No. 0002 Civil Judgment for the First Trial). The case was announced by the Supreme People’s Court in March 2014 as one of the second batch of typical cases in protecting people’s livelihood.

 

 

 

 

 

[Legislative Experience]

Since getting involved in revising Environmental Protection Lawof the People’s Republic of China (for Trial Implementation) in 1986, Prof. Wang Jinhas taken part in drafting, demonstrating or revising China’s all environment and resources protection laws, nuclear energy and nuclear safety laws and key environmental, natural resources and energy regulations and rules. He also took part in drafting such local legislations as Regulation on Environmental Protection in Hainan (1988), Regulation on Promoting Ecological Civilization Construction in Guiyang (2009), Regulation on Promoting Ecological Civilization Construction in Zhuhai (2012), Regulation on Public Participation in Environmental Protection in Hebei Province (2014), Opinions for the Implementation of Investigating Liability on Ecological Damage by Party and Government Leading Cadres in Foshan and Evaluating Methods on the Same Responsibility of Party and Government for One Position in Environmental Protection in Foshan (2016).

 


[Social Positions]

Prof. Wang Jin now serves as a Chinese member of China Council for International Cooperation on Environment and Development, Vice Chairman of China Society of Environmental and Resources Law, Vice President of Environmental Law Branch of Chinese Society for Environmental Sciences, Expert Consultant for both Trial Division on Environment and Resources in the Supreme Court and Wuxi Intermediate People’s Court, Legal Counsel for both Ministry of Environmental Protection (MEP) and State Oceanic Administration, and a part-time lawyer at Beijing Tiantai Law Firm. He also serves as Leader for the Group of Environmental Law in Expert Committee of Appraisement and Evaluation on Environmental Damage in MEP and member of Professional Committee of Environmental Monitoring in China.
