The 46th Academic Salon Successfully Held in Koguan Building

At 12:00on April,21,the 46th Academic Salon was successfully held at the conference room 307 in  PKULS  (Leo) Koguan Building. The current theme of this Salon is "1917-1937: Law and Society - comparative perspective of legal history." Professor Xu Aiguo was invited as a speaker in this Salon, and dozens of teachers participated in this event.

At first, Professor Xu Aiguo briefly introduced the influential events occurred in the period of 1917-1937, and pointed out that there are three kinds of legal thoughts in culture area at that time. Simultaneously, the west was facing the problem of social transition due to a liberal market economy with the welfare state and the October Revolution Changes in social problems arising from the rise of communism.

Subsequently, Professor Xu Aiguo analyzed legal background and comparative cultural origins in detail. He said that China's legal history was actually mixed with three kinds of cultural elements, including the inherent Chinese law traditions, the western legal traditions and the socialist traditions.

Professor Xu Aiguo took three kinds of legal relations involved in the fictions made by Lu Xun as an example, and pointed out in accordance with the background in that era that the legal thought modes judged in accordance with the habits belong to traditional Chinese style, and the legal thought modes judged in accordance with the rules belong to Western style. He also distinguished the three period of changes of Hu Shi` s constitutional thoughts.

After that, Professor Xu Aiguo made a simple comparison with the Chinese and Western legal process. He cited the American proposal law announced for dealing with communism, and views on freedom of expression, freedom of contract and show the protection of labor laws and other Western Socialization Movement. He said that China's legal conservatism was still dominant at that time, but still in the same pace with the world legal process in general.
